Police release graphic footage of officer-involved shooting in Oak Park

According to police, officers pulled the man over when they saw him walking around erratically with an open container of alcohol.

SAN DIEGO — On Wednesday, San Diego police released body camera and Smart Street Light footage of an officer-involved shooting in Oak Park from Jan 24. 

According to subtitles on the video, police approached 31-year-old Toby Diller because he was walking around with an open container of alcohol.

The video shows Officers Downing and Johnson pull over then chase after the suspect on foot, running through traffic on 54th Street. Then, the officers struggled with Diller.

According to police, the man grabbed the holstered gun from Officer Downing. Officers shot Diller and he died at the scene. 

"Both officers are still with the department," said Shawn Takeuchi with the San Diego Police Department. 

Diller's family created a GoFundMe page.

"This incident is still under investigation by our Homicide Unit and has not been turned over yet to the San Diego County District Attorney’s Office for their [its] review," Takeuchi told News 8. "The DA’s Office will examine this incident and will determine if the officers involved bear any criminal liability for their actions. In addition to the DA’s review, our Internal Affairs Unit will determine if the officers followed proper policies and procedures."
