Judge Throws Out Sunroad's Lawsuit Against City

A $40 million lawsuit against the City of San Diego by developer Sunroad has been thrown out.

The company claims it lost money when the city ordered that it remove the top 20 feet of its Kearny Mesa office tower.

A superior court judge pointed out Thursday that the FAA had notified Sunroad of a hazard, before construction on the 180 foot tower began.

A city building permit is being called a "poor decision" in the ruling, but not one that warrants a lawsuit.
