Legal Decision On SDG&E Fire Power Shut Off Plan

The Proposed Decision of PUC Commissioner Simon grants SDG&E authority to implement its Power Shut-Off Plan as a Pilot Plan with numerous conditions, including:

  • SDG&E must consult with CAL FIRE and the County of San Diego Office of Emergency Services before shutting off power.  The Pilot Power Shut-Off Plan will remain in effect until December 31, 2009.
  • The CPUC will form an Oversight Committee to determine the effectiveness of the Pilot Power Shut-Off Plan.
  • Any proposed changes to the Pilot Power Shut-Off Plan can be considered in Phase II of this proceeding, which would begin after January 2010.
  • Parties aggrieved by a notice to shut-off power may pursue equitable relief with the CPUC.

The Proposed Decision also:

  • Denies SDG&E's request for sole decision-making authority as to when to implement the Pilot Power Shut-Off Plan.
  • Denies SDG&E's request for blanket immunity.

An Administrative Law Judge Issued This Alternate Proposed Decision

  • Denies without prejudice SDG&E's Application to implement the Emergency Power Shut-Off Plan.
  • Provides general guidance regarding the contents of a subsequent application.
  • Considers the Tariff Rule 14 proposed changes to be moot in view of the denial of the Application.

The first opportunity the CPUC's Commissioners may vote on this issue is September 10, 2009.
