Court records detail why sex predator was re-arrested

SAN DIEGO, Calif. (CBS 8) - Graphic details of the fantasies of a sexual predator were revealed in court today. Matthew Hedge was arrested at his Otay Mesa trailer last week, and the reasons why are disturbing to say the least.

"He is a danger to the community. He is a designated sexually violent predator who remains a danger to the community," prosecutor Phyllis Shess said.

Matthew Hedge, 46, is back in jail seven months after his release from a state mental hospital. He's accused of using a cell phone to take photographs of a woman's legs without her knowledge, and arousing himself using a sex toy. Prosecutors want him recommitted.

"He's not allowed to have any type of materials that stimulate him sexually," Shess said.

Agents arrested the sex predator last week after he failed a lie detector exam, according to a letter filed with the court by case managers at Liberty Healthcare.

The letter says Hedge admitted to masturbating weekly while watching women's volleyball on television in his trailer outside Donovan State Prison, where he's been living at taxpayer expense since April.

"We have no information about the age of the volleyball team he was watching," Shess said.

In court Thursday, Hedge's attorney came to his defense.

"There is no indication that Mr. Hedge had approached or contacted any child, no indication he has committed a new crime, no indication he has even fantasized about a child," public defender Marian Gaston said.

Hedge was convicted of molesting four children in 1989. He was released in 2005, but quickly arrested again after News 8 aired video of children entering his halfway house. He spoke to both girls, a violation which sent him back to the mental hospital.

Liberty Healthcare, a subcontractor for the state Department of Mental Health, routinely hires drivers to take Hedge to doctor's appointments. News 8 recorded video of Hedge being picked up at his trailer in Otay Mesa over the summer. His driver was a 29-year-old woman.

It's unclear if she's the same female driver referenced in the Liberty Healthcare letter when it says, "Mr. Hedge admitted to having taken pictures of his female driver's legs... He took the picture without her knowledge and admitted to having attempted to use it for masturbatory purposes."

"Yes, it's concerning that he's taking surreptitious photographs that seem to aid in his sexual fantasies," Shess said.

Under the terms of his release Hedge is required to inform case managers of his sexual fantasies and practices.  Liberty Healthcare says he did not do that.

Hedge remains in jail and his revocation hearing is set for Dec. 9.
