SAN DIEGO, Calif. (CBS 8) - The family of an unarmed black man shot and killed by a former BART officer in Oakland is speaking out.

A letter of apology from Johannes Mehserle has been issued, but the family says the letter was not addressed to them but, instead, addressed to the public.

Mehserle was convicted this past week of involuntary manslaughter in the January 2009 shooting.

Prosecutors had asked for second-degree murder conviction.

Outrage over the verdict set off riots in Oakland on Thursday night.

Mehserle maintains that it was a mix-up, and he intended to shoot grant with a stun gun.
