Santos family files wrongful death lawsuit against men convicted in son's death

SAN DIEGO (CNS) - The family of a young man fatally stabbed near San Diego State University filed a wrongful death lawsuit against the four men convicted in the case, one the son of a former Assembly speaker, it was announced Wednesday.

Fred and Kathy Santos filed the suit against Esteban Nunez, Ryan Jett, Rafael Garcia and Leshanor Thomas in San Diego Superior Court, claiming they are civilly liable for the Oct. 4, 2008, death of their son, Luis Santos.

The complaint asks for unspecified damages.

"What Fred and Kathy Santos are seeking is justice and accountability," said their lawyer, Stephen Estey. "Luis' life was priceless, and there is no number large enough for the loss of a loving and loved son."

Prosecutors said Jett inflicted the fatal wound on Santos, 22, in a fight near SDSU.

The four defendants pleaded guilty to various charges, and Jett and Nunez were given prison terms of 16 years each.

Former Gov. Arnold Schwarzenegger, however, commuted the sentence for Nunez to nine years. Nunez is the son of Fabian Nunez, a former Assembly speaker during Schwarzenegger's tenure.

That prompted another lawsuit by Santos' parents, who claimed their constitutional rights were violated because the former governor did not contact them before he commuted the sentence.
