SAN DIEGO (CNS) - Prosecutors declined to file charges Wednesday against a 74-year-old Lincoln Park man arrested on suspicion of attempted murder for a run-in with a neighbor who was stabbed and struck with a broomstick.

A spokesman for the District Attorney's Office, Steve Walker, confirmed that prosecutors decided against bringing charges against Eugene McFarland in connection with the incident involving the 64-year-old neighbor last Friday night.

A prosecutor said there wasn't enough evidence to overcome McFarland's claim that he hit and stabbed his neighbor in self-defense.

According to a report in the Los Angeles Times, McFarland alleged the neighbor had been shooting at his cat and five kittens with a pellet gun, then got a dog to harass the cats when warned about using the pellet gun.

McFarland alleged the neighbor again sent his dogs after the cats Friday night, then came up to McFarland and hit him with his cane. McFarland said he stabbed the neighbor with a knife he had been using while gardening, the newspaper reported.
