Veteran SDPD cop investigated for felony battery of a juvenile

SAN DIEGO (CNS/News 8) - A recent neighborhood dispute has led to accusations of criminal misconduct against a San Diego police officer, one of six department members to face such allegations in recent weeks, a police spokeswoman said Thursday.

The patrolman, who neighbors have identified as Burt Hulbert, has been transferred to desk duty pending the outcome of an internal investigation and a concurrent review by the District Attorney's Office, said police public affairs Lt. Andra Brown.

The allegations against the officer involve an April 11 off-duty altercation with a 17-year-old  Rancho Bernardo resident who had been visiting a friend who lives next door to Hulbert in Mira Mesa. According to neighbors, Hulbert came across the 17-year-old victim in a parked car, reportedly smoking marijuana, and threatened to place him under citizen's arrest. However, the victim tells News 8 that he did not resist arrest.

According to the teen's father, the officer allegedly struck his son during the dispute, causing a facial fracture requiring a trip to a hospital.

The department forwarded the case to prosecutors "within the last several days," according to Brown.

According to authorities, the officer faces battery charges on a juvenile. The District Attorney's office will review the case to determine if felony charges are warranted.

Neighbors of Hulbert defend the officer, calling him a good neighbor.

"He's a good guy, " one neighbor, Yun Kurland, told News 8. "He always tries to look out for everybody to make sure the community and neighborhood are safe."

Five other SDPD officers also have come under suspicion of illegal conduct over the last two months.

In February, San Diego police Sgt. Kenneth H. Davis was charged with one count of stalking a female fellow officer and three counts of making harassing telephone calls to her. A preliminary hearing for Davis, who has been with the department for 23 years, is scheduled for next week.

An SDPD motorcycle patrolman, meanwhile, is under investigation for allegedly causing an off-duty Feb. 22 traffic accident on Murray Ridge Road in Serra Mesa while intoxicated and fleeing the scene of the crash. The District Attorney's Office is reviewing the allegations against Officer David Hall, 41.

Last month 42-year-old Art Perea, a vice officer with the department, resigned amid accusations of raping a Point Loma Nazarene University student at an El Cajon home. He has not been charged in the case, which remains under investigation.

On March 11, SDPD Officer Anthony Arevalos, 40, was arrested after a woman accused him of sexually assaulting her following a traffic stop in the Gaslamp Quarter. Four other women subsequently came forward and made similar allegations against Arevalos, who has pleaded not guilty to 18 felony counts, including sexual battery, false imprisonment, assault under color of authority and receiving a bribe.

On March 24, San Diego police Officer Roel Tungcab was arrested by sheriff's deputies in the aftermath of a fight with his wife at their Imperial Beach home. Tungcab, 39, faces misdemeanor domestic-violence charges.
