Female cop testifies she was stalked by SDPD sergeant

SAN DIEGO (CBS 8) - A San Diego police sergeant came face to face in court Wednesday with the fellow officer accusing him of stalking her. A judge had to determine whether a felony charge is warranted in the love affair gone bad.

Sergeant Kenneth Davis, 47, began the affair with the female officer in 2008, when both were married.

"I told him that he needed to file for divorce and that I was going to be filing for divorce, and that I wanted it to work and wanted him to stay," the officer said.

Davis is now charged with felony stalking of his co-worker after the relationship went sour in 2010. The female officer, who News 8 is not identifying, testified that Sgt. Davis threatened her.

"He needed me to know that he was serious, and if i ever left him he would kill me," she said.

The officer said she repeatedly told Davis the relationship was over, but he continued to call her, send her unwanted text messages, write her letters and a poem and drive by her home. In August 2010, the female officer testified she and Davis came face to face at a gas station, and she thought he might shoot her.

On cross examination, defense attorneys got the alleged victim to admit Sgt. Davis never actually threatened her with a weapon.

"He never pointed a gun at me and never threatened to shoot me.  He just made the statement if I ever left him," she testified.

A criminal investigation began after the alleged victim reported the behavior to her lieutenant.

"I said 'Are you afraid of him?' And her lip started quivering and she said she afraid of him and in fact her children were afraid of him and I said 'Okay, I'm going to move to the next level,'" Lt. Natalie Stone testified.

Four other San Diego police officers have been accused of various crimes over the past several months.

A motorcycle officer whose name has not been released by the department is under investigation for allegedly causing an off-duty Feb. 22 traffic accident on Murray Ridge Road in Serra Mesa while intoxicated and fleeing the scene of the crash. The District Attorney's Office is reviewing the allegations.

In March, an SDPD vice officer resigned amid accusations of raping a Point Loma Nazarene University student at an El Cajon home. He has not been charged in the case, which remains under investigation. Police have withheld his name as well.

On March 11, Officer Anthony Arevalos, 40, was arrested after a woman accused him of sexually assaulting her following a traffic stop in the Gaslamp Quarter. Four other women subsequently came forward and made similar allegations against Arevalos, who has pleaded not guilty to 18 felony counts, including sexual battery, false imprisonment, assault under color of authority and receiving a bribe.

On March 24, SDPD Officer Roel Tungcab was arrested by sheriff's deputies in the aftermath of a fight with his wife at their Imperial Beach home. Tungcab, 39, faces misdemeanor domestic violence charges.
