Daycare owner's husband arrested on molestation charges

Posted: Updated:

San Diego (CBS8) -  San Diego Police Child Abuse detectives are taking child molestation allegations at a Shelltown in home licensed daycare seriously after a 4-year-old girl comes forward.

"The mother and the child were alone together at home and for whatever reason the child disclosed to the mother, and was extremely emotional about what happened," said Lt. Rudy Tai, with the Child Abuse Sex Crimes Unit within SDPD.

Meanwhile, Guadalupe Herrera is still trying to deal with the allegations that her husband molested three separate children inside their daycare.

"I very upset because I know, I knows my husband," she explains.

Despite what she thinks of her husband, San Diego Police say a four-year-old girl told her mother that 52 year old Hector Herrera touched her inappropriately.

"Once the mother got that information she also interviewed her two boys as well," Lt. Tai said.

Both of them, ages 6 and 8, alleged that Herrera touched them as well.

Wednesday morning shortly before 7a.m. child abuse detectives showed up at the Shining Stars daycare in the 3900 block of Boston Avenue.  Guadalupe says she welcomed the officers in thinking they were daycare license officials coming to inspect and approve her request for a license to watch more children.

She adds that the investigators told her the daycare was closed for the day and had told some mothers arriving to drop off their kids that the center was closed.

After some talking back and forth, one officer told Hector Herrera the reason they were there.

"My husband said what? No, no, no, no. Not me, no sir I don't do nothing," recalls Quadalupe Herrera.

She says her husband went with police for further questioning on Wednesday, and she later found out they'd arrested him on charges for Lewd Acts with a Child Under the age of 14.

For at least one woman who uses the daycare, it's an allegation out of left field.

"I don't believe it at all he's always been good with my kids and so has his wife they've always been good to my kids never had a complaint about anything," says Laura Aguillon. "They're safe, I know they're safe there."

Others in the neighborhood also insist Hector Herrera never came across in an ill manner towards any of the kids in the neighborhood.

Guadalupe tells us investigators took all of her client files. Lieutenant Tai says they're doing their due diligence by contacting any families who've used the daycare to see if there are any other alleged victims. He urges anyone with additional information on possible incidents at the daycare to come forward.

The daycare remains open after being closed just during the investigation on Wednesday.

Hector herrera is scheduled to be arraigned tomorrow at 1:30p.m. in a San Diego country courtroom.
