Preliminary hearing for alleged 'peeping tom' attorney postponed

SAN DIEGO (CNS) - A preliminary hearing was postponed Wednesday until July 20 for a North County defense attorney accused of secretly recording women on video at an Escondido tanning salon, possessing child pornography and carrying a concealed weapon in his vehicle.

David Taylor Kaye, 43, faces a maximum of eight years and two months in state prison if convicted, said Deputy District Attorney Annette Irving.

The San Marcos resident is charged with two felonies -- possession of child porn and carrying a concealed loaded unregistered firearm -- and nine misdemeanors, including four counts each of peeking through a private area and secretly recording images and one count of destroying evidence.

Irving said the misdemeanor counts stem from alleged conduct last March and April, and the felony conduct allegedly occurred last July 22.

Seven people, including a 15-year-old girl, have been identified as possible victims of Kaye, but only four are named in a criminal complaint, Irving said.

Kaye, who was arrested Jan. 21, was the subject of a 10-month investigation that started when he was allegedly seen recording images of women in various stages of undress at a local tanning salon. He was initially arrested on April 19, 2010 and charged with four misdemeanor counts of secretly filming a person, according to Escondido police Lt. Craig Carter.

On July 22, Escondido police served a search warrant at Kaye's house and business and recovered additional evidence, Carter said.

After that, police worked closely with the District Attorney's Office and a court-appointed Special Master for the investigation due to Kaye's occupation, Carter said.

More evidence allegedly found on Kaye's computers and phones led to his arrest and the additional charges in January, according to the lieutenant.
