Closing arguments in trial of man accused of sexual assault on mentally impaired relative

SAN DIEGO (CNS) - Closing arguments were scheduled to begin Monday in the trial of an ex-con and gang member accused of sneaking into a Serra Mesa home and sexually assaulting a 13-year-old mentally disabled female relative.

Imshay Segrest is charged with two felony counts of committing a forcible lewd act on a child and one felony count of being a felon in possession of a firearm. The 30-year-old defendant faces 25 years to life in prison if convicted.

In her opening statement, Deputy District Attorney Nicole Rooney told jurors that the victim's father was awakened by his daughter's screams in the early morning hours of Jan. 29 and rushed to her room to find her on the floor with her pants off and the defendant on top of her in a sexual position.

The girl has speech problems and the mental capabilities of an 8-year-old, she said.

Segrest allegedly punched a hole in the wall and fled while the girl's father was on the phone with police. He was arrested at his Ritchey Street home in Skyline on Feb. 1.

Prior to his arrest for the alleged sexual assault earlier this year, Segrest had been to prison for evading police and drug convictions.
