San Diego seeks to close pot shops near schools

SAN DIEGO (AP) - The San Diego city attorney is seeking to shut down a dozen medical marijuana dispensaries near schools.

Jan Goldsmith said Wednesday that he's seeking court injunctions to close the dispensaries because they are putting children at risk.

The legal action comes two months after the City Council rescinded an ordinance regulating where dispensaries could operate. Medical marijuana advocates called the ordinance too restrictive and gathered enough signatures to place a repeal on the ballot. The City Council didn't want to pay up to $1 million for a public vote.

Goldsmith said that without an ordinance, he had to turn to the court due to conflicting federal and state law on the sale of medical marijuana. He says a judge could craft interim rules that would shut down violators.
