SAN DIEGO (CNS) - A judge Wednesday rescheduled a preliminary hearing for Oct. 26 for one of two people accused in the Halloween 2007 shooting of a Skyline man in what authorities characterized as a retaliation slaying.
Michael Jay Aguon, 23, is charged with murder in the Oct. 31, 2007, death of 32-year-old Vidal Balderas Jr.
Rafael Meraz, who was a minor at the time of the killing but is now 19, is being tried as an adult. His trial has already been set for Jan. 10.
Police said Balderas was shot six times as he returned to his Coolwater Drive home from taking his daughter trick-or-treating. He died at the scene.
His sister, Wendy Balderas, testified during an earlier hearing that Meraz had come by her family's home 10 days earlier, shouting gang slogans and flashing a gun. Meraz was punched and his gun was taken away by the victim, witnesses said.
