Man accused of raping and robbing store clerk ordered to stand trial

VISTA (CNS) - A 19-year-old man accused of raping and robbing a store clerk at her North County workplace must stand trial on multiple felony charges, a judge ruled Tuesday.

After a daylong preliminary hearing, Vista Judge Steven E. Stone ruled that enough evidence had been presented for Hugo Elmer Garcia to stand trial on charges of kidnapping for purposes of a sexual assault, rape and robbery.

The defendant faces 69 years to life in prison if convicted, said Deputy District Attorney Jodi Breton.

Garcia will be back in court Oct. 25, when a trial date could be set.

Besides the rape and robbery, Garcia is accused of stealing the victim's sports utility vehicle, then attempting another holdup four hours later in the same Escondido neighborhood last May 18.

Garcia was arrested after being spotted sitting in the store clerk's SUV by Escondido patrol officers, who were responding to a report of an attempted holdup, police said.
