EL CAJON, Calif. (AP) — A San Diego County man who shot his baby daughter and mother-in-law before killing himself was carrying handguns that authorities had confiscated and then returned.

The North County Times says the Sheriff's Department took Kevin Collier's weapons for safekeeping when he was hospitalized in 2008 for 72 hours of mental evaluation and treatment.

However, the guns were later returned.

The 32-year-old Ramona man was armed with two handguns in August when he wounded a police officer, killed his 14-month-old daughter and mother-in-law at her El Cajon residence, then shot himself after torching the home.

Collier's wife recently had filed for divorce. She wasn't home during the attack.
