SAN DIEGO (CBS 8) - The parents of a toddler, who choked on a pushpin at a North County preschool, have filed a wrongful death lawsuit.
Aja and Daniel Howell are seeking unspecified damages against the Oceanside Montessori school for the death of their three-year-old son Tyler.
An attorney for the parents believes Tyler died as a result of negligence. He says pushpins are a well-known hazard for children and by having them, the preschool failed to provide a safe environment.
The Howell family is hoping this lawsuit will lead to a ban on pushpins in preschools.
