Spitting student now facing criminal charges

CHULA VISTA (CBS 8) - A Chula Vista middle school student was suspended for five days, then kicked out of school for spitting out of a school bus window. Now the 12-year-old is facing a criminal charge of battery for the January incident.

The boy's mother now says she'll appeal the charge.
