Garcia was unable to get out of the Kia Rio, which sunk upside down, after her boyfriend lost control of it on Calavo Drive near Nordahl Road, just west of Escondido shortly before midnight Monday.
Robert Aaron Anderson, 33, who was driving, got out of the car almost immediately. So far. he has not been cited in the accident, according to the California Highway Patrol, which is in charge of the investigation. An officer said Anderson was suspected of speeding.
Jarit Welles, a 22-year-old man who lives nearby, dove into the pool, cut Garcia's seat belt and got Garcia out of the water, but she never regained consciousness.
Calavo Drive is sometimes called "roller coaster road" because of dips in the road.
