SAN DIEGO (CBS 8) - A former Border Patrol union president accused of using union money for personal use, wants the case against him thrown out.
T.J. Bonner's attorney says agents carried out an illegal search of his home and they should not have been involved because it should have been a homeland security investigation.
"They wanted to use this case to expand their powers beyond what is legitimately given to them," says Gene Iredale, Defense Attorney for Bonner.
Bonner believes he was targeted for being outspoken during the 20 plus years he served as president.
Agents allegedly seized more than four million pornographic images from a home computer. Bonner is also accused of using union money to visit his mistress in Chicago.
A January court date has been pushed back to March.
