On February 22, Rapid Recovery Solution, a debt collection agency, issues a response to an article published on NJ.com concerning collection services and debtors’ rights when handling a debt or in cases of abuse by collection agencies.
The NJ.com article reports that “[The Fair Debt Collection Practices Act (FDCPA)] prohibits debt collectors from using abusive, unfair or deceptive practices to collect from you, according to the Federal Trade Commission.” Debtors are encouraged to conduct research on the collections agencies contacting them and to read up on their rights, which are available through the Federal Trade Commission.
According to the article, debt collectors cannot call the debtor incessantly or deceive them by claiming the person owes a false debt. “The debt collector must send you a written notice, called a ‘validation notice,’ within five days after it contacts you, said the FTC,” Mueller wrote. “The notice must include the creditor’s name, and what you should do next if you do, or don’t, owe the money.”
