City attorney clarifies laws about pot dispensaries

SAN DIEGO (CBS 8) - San Diego City Attorney Jan Goldsmith Thursday tried to clarify the current legal status of medical marijuana dispensaries in the city.

This comes just days after federal agents and sheriff's deputies raided a medical marijuana dispensary in downtown San Diego.

Goldsmith says that despite Mayor Bob Filner's claims in the media that the dispensary is legal, it is not. The city attorney reiterated that marijuana dispensaries are a criminal enterprise under federal law. He also says there is no current zoning ordinance that allows dispensaries to exist anywhere in the city.

"Our office is more than willing and happy to work with the council and the mayor on a new ordinance. But until that new ordinance is adopted. Under current law, all dispensaries and collectives are not allowed," Goldsmith said.

When asked about Goldsmith's comments, Filner replied that he would take the city attorney seriously if he talked to him personally, and not to the media.
