Man accused of threatening can collector with gun near Balboa Park

SAN DIEGO (CBS 8) - A man was arrested after pulling a gun on someone going through his trash.

Police say the gunman was at his apartment building in Cortez Hill when he saw a man collecting cans. He yelled at him and then came downstairs.

"One of the residents became upset because of the noise below him and got into a confrontation verbally with the individual," said Lt. Paul Rorrison.

It happened just before 1 a.m. on Friday.

Police say 34-year-old Duane Shewmaker who lives right above these trash dumpsters threatened to physically attack this man who was collecting cans.

The victim who did not want to be identified told authorities Shewmaker armed with a baseball bat and a handgun came running towards him and grabbed his bag of recyclables.

"At which point pointed the handgun at the individual and cocked around threatened to shoot him," said Rorrison.

"I'm kinda in fear for my life, I'm not even coming around here no more did he say anything...I'm gonna win this fight tonight...that's all I remember," said the victim.

Police surrounded the apartment unit on the 1600 block of 9th Avenue and finally got Shewmaker to surrender.

Neighbor Rolanda DeLarosa says the news is disturbing.

"To walk by and see someone digging in your trash it could be disturbing," she said.

The handgun and baseball bat were recovered. The bag of recycle goods were also returned to the homeless man.

Neighbors say this is not the first time Shewmaker has gotten outraged by the can pickers.

Two weeks ago he was seen chasing down a man with a baseball bat for rifling through the trash.

Rojelio Ramirez who was out recycling in the middle of the day in those same dumpsters says he too has had an encounter with Shewmaker.

Duane Shewmaker's bail is set at $100,000. He's scheduled to be arraigned next Tuesday.
