Judge bans porn evidence against ex-union leader

Posted: Updated:

SAN DIEGO (AP) — A judge in San Diego has barred prosecutors from using porn evidence in the fraud case against a former Border Patrol union leader.

U-T San Diego reports (http://bit.ly/1b6DnOS) the federal judge last month ruled that authorities can't use pornographic images that they say were on computers seized at T.J. Bonner's Campo home last year.

The judge says the seized material wasn't in the search warrant. Prosecutors have asked him to reconsider.

Bonner has pleaded not guilty to conspiracy and wire fraud. The government says he illegally received hundreds of thousands of dollars from the union over 20 years.

Prosecutors claim Bonner made phony expense and pay claims while on nonunion business, such as visiting a mistress in Chicago, traveling to sports events and downloading pornography.
