La Jolla man told his Halloween display has to go

SAN DIEGO (CBS 8) - A La Jolla man says a Grinch is trying to ruin his Halloween after receiving a letter from his homeowners association saying that his decorations have to go.

It's the most frightening yard on the block. A terrifying terrace filled with the season's usual suspects. But it's not Halloween that scares Michael Cardenas -- it's his HOA.

"They're Debbie Downers and that's kind of sad,that they can't enjoy people just having fun," he said.

Last week he got a letter from his HOA telling him no holiday decorations can be displayed in common areas. They said he could leave them up this Halloween, but never again. Now attorneys are involved.

"We have people taking pictures here daily. They come in, want to take pictures, they say it's beautiful decorations, they are enjoying it," he said.

Michael says his enclosed terrace is not a common area, and he's not making any permanent modifications. Nonetheless, he has until Friday to take his decorations down, and depending on what his lawyer says, this could be his home's last Halloween.

"Look, I'm not trying to offend anybody. I am not trying to curtail any of the property owners' enjoyment of life, enjoyment of this beautiful community. I was just trying to bring some holiday spirit, that's it," he said.
