Man killed after gun accidentally fires in Bay Ho

SAN DIEGO (CNS/CBS 8) - A 21-year-old man was fatally shot while being shown a gun that fell and accidentally fired early Sunday in the Bay Ho neighborhood, a police lieutenant said.

Police and paramedics were called to the 4900 block of Gallatin Way near Delta Place about 1 a.m. and found the mortally wounded man lying on a residence's front lawn, suffering from a gunshot wound to his upper torso, San Diego police Lt. Mike Hastings said.

He was taken to a hospital, where he died, according to Hastings. His name was withheld pending family notification.

Witnesses told police the victim's long time friend was showing him a gun, when it fell to the ground and discharged, Hastings said.

"I was just laying in bed watching Sports Center and heard a couple of gun shots," neighbor Tim Sherman said. 

Tim Sherman lives just a few doors down and couldn't believe what he saw early this morning. 

"I was kind of startled at first and then I kind of just got up and went to see what was going on and saw sirens and police cars and stuff," Sherman said. 

Marci Sullivan knows the family and says the shooting was an accident. 

"When I walked by I just started shaking and I just had to ask someone what happened because this does not happen around here," she said. "What I heard was that one of the sons was cleaning a gun and that the gun went off at about 1:30 in the morning...and apparently had shot his best friend."

Police say the gun fell and went off when it hit the ground. When paramedics arrived they found a 21-year-old man lying on the front lawn with a gunshot wound to his chest. 

"Very very close family. They always have a lot of children around...just always been a very close and loving family," Sullivan said. 

There's always a lot of children around because neighbors say the woman who owns the home operates a daycare out of it. Online it shows the name is the Orr Family Daycare and Preschool is at that address. 

"It's a very very tragic situation. They're a very loving family. It's just come as a shock to everyone in the neighborhood," Sullivan said. 

Police questioned the friend of the victim and haven't said if any charges will be filed. They're also waiting to release the name of that victim. 

"I'm really sorry for everyone that has been involved in this..it's a definite tragedy for everybody," Sullivan said.
