SACRAMENTO (CBS 8) - More than 100 people rallied in Sacramento Tuesday, calling for the immediate release of a U.S. Marine being held in Mexico.

The protest was held outside a building where Mexican President Enrique Pena Nieto was attending a reception.

Andrew Tahmooressi has been in a Mexican prison since March 31, when he crossed the border with weapons. Tahmooressi claims it was an accident.

State lawmakers Tuesday questioned why the Mexican president won't help secure his release.

"Why wouldn't you, in the interest of justice, intervene and effect his release so that he can come home and get the treatment that he needs?" State Assemblyman Tim Donnelly said.

Tahmooressi's mother has said her son suffers from PTSD from his tours in Iraq and Afghanistan.
