SAN DIEGO (CBS 8) – New charges have been filed against a married San Diego police couple, Bryce and Jennifer Charpentier are accused of dealing prescription pills and the husband could face new charges of assault.

“Mr. Charpentier on November 4 essentially went out hunting at 3 o'clock in the morning looking for a fist fight with some individuals who turned out to be victims after he attacked them,” said Assistant District Attorney Matthew Tag.

Bryce Charpentier is out on bail and admitted he was under the influence of a controlled substance during the assault.

Charges have not been filed in that incident. Tag says the case is still under investigation.

The Charpentier's are now accused of conspiring to buy and sell hydrocodone. They're also accused of using a police radio to fabricate calls in order to steal medications from patients with a legal prescription.

Court records show, “Jennifer Charpentier text messaged Bryce Charpentier that she is ready to call in a fictitious "CW" call so Bryce Charpentier can respond and attempt to steal medication."

Prosecutors also say the couple stole medication from Jennifer's mother, and allege Bryce sold prescription drugs while his son was with him.

“Jennifer Charpentier offering a hydrocodone distributor to take over his distribution network here in San Diego County,” said Tag.

The couple was originally charged with illegally selling hydrocodone in June.

The couple is also charged with conspiracy to commit residential burglary while on duty.

Records show Jennifer Charpentier convinced someone to lock himself in the bedroom while Bryce Charpentier stopped to use the restroom while on duty. The victim reported legal prescriptions missing from the home.

If convicted Jennifer Charpentier could face 11 years in prison and Bryce Charpentier could face 14 years and 4 months in prison.

The two will be back in court on Wednesday for readiness hearing.

Three charges were added on Monday including Conspiracy to commit residential burglary while on duty and carrying a firearm, conspiracy to commit a crime while in possession of hydrocodone and conspiracy to commit a crime, sale of controlled substances (hydrocodone). In June Bryce Charpentier's was charged with Sell/Furnishing controlled narcotic substance while carrying a firearm during the alleged crime. Jennifer Charpentier was charged with Sell/Furnish controlled narcotic substance. The two are also charged with possession of a firearm by a felon or addict.

The San Diego Police Chief suspended the couple of their police powers when they were arrested in June.

They've pleaded not guilty to all charges.
