Arraignment for San Marcos assault suspect postponed

VISTA (CNS) - A man accused of committing domestic violence and sexual battery at an apartment in San Marcos was charged Friday with a half-dozen felony counts, including kidnapping and false imprisonment.

Arraignment for 37-year-old Garth Clem was rescheduled to Monday because he is undergoing a psychological evaluation, said Deputy District Attorney Natalie Villaflor.

Clem was taken into custody in the 600 block of South Twin Oaks Valley Road on Tuesday night, according to San Diego County sheriff's Sgt. Paul Michalke.

Around 8:15 p.m., deputies were asked to conduct a welfare check at an apartment in the area, and once there, they heard a female screaming and a witness directed them to an apartment, Michalke said.

The screaming female met deputies at the front door and was taken to a local hospital so she could be treated for injuries she suffered in an alleged domestic violence assault, he said, adding deputies contacted Clem inside the apartment and he was taken into custody with the help of a police dog.

"It was later determined there were two additional victims of a sexual battery," Michalke said without elaborating.

Clem remains jailed in lieu of $260,000 bail. He faces up to nine years and eight months in state prison if convicted, Villaflor said.
