Retrial postponed for pregnant murder suspect

VISTA (CBS 8) - A retrial was postponed Monday for a Carlsbad woman accused of killing her husband.

Julie Harper was acquitted on first degree murder charges and was supposed to be retried on lesser charges starting next month. On Monday, her attorney asked that the retrial be postponed because she is pregnant and the pregnancy is considered to be high risk.

The prosecution argued that there have been too many delays and that the delays are weighing heavily on Jason Harper's family. The prosecution also said they had more than 30 witnesses ready to testify at next month's trial.

Ultimately, the judge granted the postponement, setting a trial date for September.

Julie Harper reportedly became pregnant through in vitro fertilization. Prosecutors believe she knew she was pregnant when the retrial date was set and is using her pregnancy to manipulate the system. They also say her pregnancy and the father could play a role in this case. However, her attorney says the pregnancy is a private matter.

According to paperwork filed with the court, the prosecution said if the baby is that of her husband, it would hurt her case because during her first trial she had made claims that she was afraid of him.

There is another hearing scheduled to determine if her pregnancy can be brought up during the retrial.

The identity of the father of her baby has not yet been revealed.
