SAN DIEGO (CBS 8) - The fight is on to save a popular student hangout at UC San Diego. UC San Diego representatives are trying to shut down the Che Cafe and in response students are holding a rally Tuesday morning to keep the campus landmark open.


The Che Cafe is a co-op, social center, and live music venue at UC San Diego and has been in existence for 35 years.


At the center of the debate is whether or not the cafe needs retrofitted fire sprinklers. Some students say the building does not legally require the retrofitted fire sprinklers. They say UC San Diego officials have overstepped their boundaries.


The fight is nothing new, UC San Diego tried to close the Cafe by changing the locks in 2000. Now a court has sided with UC San Diego leaders and says students can be evicted.


"I think it would be very tragic to lose places like that on a University campus. It's supposed to promote those kinds of things. By not protecting the Che I think it shows that they failed to care about those things like diversity and critical thinking,” said Che Cafe Spokesperson, Raquel Calderon.


The student-run Che Café faces eviction Tuesday.
