NTSB: Pilot error likely cause of crash in Carlsbad

CARLSBAD (CBS 8) - A National Transportation Safety Board (NTSB) report blames pilot error and an empty fuel tank for the crash-landing of a plane that injured a 12-year-old boy.

The plane lost power while towing a banner on the Fourth of July.

The report says pilot, Luke Kanagy, didn't properly manage the fuel system. The lack of fuel led to engine failure, which brought the plane down on the crowded beach.

It hit Nicholas Baer, damaging his skull. He underwent successful brain surgery at Rady Children's Hospital.

Baer's family has filed a lawsuit against the pilot and the banner advertising company.
