San Diego judge who advocated "birther" movement under investigation

SAN DIEGO (AP) - A state watchdog panel is investigating a San Diego Superior Court judge who was an advocate of the debunked "birther" movement.

The California Commission on Judicial Performance has opened formal proceedings into Gary Kreep, who is accused of violating judicial ethics when he sent fundraising letters during his election campaign in 2012 challenging President Barack Obama's citizenship.

The panel said there have been allegations of "lack of proper courtroom decorum" including comments about the physical appearances of lawyers and crude language on the bench.

Kreep has until late October to respond and a hearing will be held. A lawyer did not immediately respond to a request for comment.

Last year, the Fair Political Practices Commission said Kreep agreed to pay a $6,000 fine for financial irregularities in his 2012 campaign.
