Ex-Oceanside basketball coach gets probation in student sex case

VISTA (CNS) - A former Oceanside High School basketball coach and physical education teacher who had sex with a female student, beginning when she was 15, was sentenced Wednesday to three years probation and ordered to give up his teaching credential.

Corey Lane Hogue, 38, a father of three, pleaded guilty in October to a felony charge of unlawful sexual intercourse with a minor more than three years younger than him.

As part of his sentence, Vista Judge Aaron Katz suspended a one-year jail sentence as long as Hogue violates no laws while he's on probation. The judge told Hogue to stay away from children younger than 18, except for his minor son.

The defendant was ordered to complete a year of intensive counseling and to do 30 days of public work service.

Katz told the defendant that if he violated probation, he would lift the stay on the jail time and may impose a three-year prison term.

The judge did not make Hogue register as a sex offender, because a psychologist determined that the defendant was not a predator and not likely to re-offend, according to Deputy District Attorney Vanessa Duvall.

Katz said he would retain jurisdiction on the case and would hold frequent hearings to monitor Hogue's performance on probation, Duvall said.

The victim's mother told the judge that her daughter -- now 18 -- was hospitalized last night with a panic attack and couldn't attend the sentencing.

The victim testified at a preliminary hearing in July that Hogue began approaching her in the fall of 2007, when she was a sophomore.

The girl said Hogue would come up to her in the gym and kiss her on the lips when no one was around. The relationship continued through 2008, despite her saying she didn't want to have intercourse, she said.

Once she started having panic attacks, she told the detectives about the sexual behavior.

Hogue had been employed by the Oceanside School District since August 2006. He had taught at Orange Glen High School in Escondido.

After his arrest, Hogue was put on leave, pending the outcome of the criminal case.
