SAN DIEGO (CNS) - Two nurses who engaged in sex acts in front of a 98-year-old female stroke victim have been sentenced to 325 and 365 days in jail, respectively. 

Russel Torralba and Alfredo V. Ruiz, both 43, pleaded guilty in February to a felony charge of inflicting mental suffering on an elder. Torralba also pleaded guilty to a misdemeanor count of elder abuse.

Surveillance video footage showed Torralba fondling Ruiz on multiple occasions in 2011 in the victim's room, according to Deputy District Attorney Paul Greenwood.

Attorneys for the defendants argued at a preliminary hearing last year that while the behavior was "inappropriate," there was no evidence that the female stroke victim was neglected, suffered injuries or that she was even aware what was taking place next to her.

Judge Lorna Alksne called the defendants' behavior "shocking" but dismissed a count of lewd and lascivious behavior.ks and of the service organizations that helped with the recovery and rescue efforts.
