VISTA, Calif. (AP) - A man and a 16-year-old girl must stand trial for allegedly drugging and raping a teenager in San Diego County.

A judge on Wednesday threw out conspiracy charges but ruled that 18-year-old Giovanni Abarca and the girl will stand trial as adults on sex charges.

Sex-related charges were dismissed against a third defendant, 24-year-old David Perez, but he'll stand trial on child abuse, drug and theft charges.

Prosecutors contend that the teenager gave a 16-year-old friend some water spiked with Ecstasy to intoxicate her so the men could sexually assault her at Perez's apartment in Vista last fall.

The North County Times says the alleged victim told police she remembered being sexually assaulted but denied it on the witness stand this week.
