SAN DIEGO (CNS) - No charges will be pressed against a man initially believed to have tried to kidnap a young boy following a Fourth of July party in the Fox Canyon neighborhood of San Diego.

According to San Diego Police, no crime was committed because it appears the child was told to get in the family truck as they were leaving a party. The kid went and got in the wrong truck and fell asleep. 

The suspect did not know the child was in the car.

Michael Todd Mahurin, 52, had booked into San Diego Central Jail on suspicion of kidnapping, false imprisonment, illegal possession of a controlled substance and driving without a valid license.
