SAN DIEGO (CBS 8) - A man accused of intentionally infecting others with HIV was expected in court Thursday, but his hearing was postponed and he could be facing new charges

Thomas Guerra is currently charged with one count of violation of the health and safety code.

Two local men are accusing Guerra of infecting them with the virus. One man who spoke to CBS News 8 says he and Guerra dated for about a year before he discovered shocking text messages on Guerra's cell phone.

"There's hundreds and hundreds, if not thousands, of text messages where he's talking about intentionally infecting people with HIV," he said. "Texts where he's stating he's negative to people then bragging to others about giving people his 'positive load.' It's crude, it's… I don't know how someone could treat another individual like that."

Guerra has been charged by the San Diego City Attorney's Office with one count of willfully exposing himself, as an infectious individual, to another person, a misdemeanor with a maximum sentence of six months, and $1,000 fine.

    In 2006, the city of San Diego began allowing political campaigns to electronically file their financial reports, giving the public easy access to information on money in city politics. The county of San Diego wasn’t as quick to make the same kind of information available and continues to lag behind the city’s efforts.
