Man accused of sexually assaulting 5-year-old girl in Linda Vista pleads not guilty

Alejandro Confesor's arraignment follows a nearly four-day-long search that ended with San Diego police arresting him on Sunday.

SAN DIEGO — The man accused of entering a Linda Vista home and sexually assaulting a 5-year-old girl pleaded not guilty in court Wednesday.

Alejandro Jose Confesor, 22, faced a judge in Downtown San Diego Court Wednesday and pleaded not guilty to lewd and lascivious acts with a child under 14 with force, sex crime with specific circumstances, assault with intent to commit rape or other sex acts during residential burglary, burglary, and trespassing.

The judge agreed to the prosecutor's request for no bail due to the nature of the charges and allegations.

"Someone who returns to a residence and commits the crimes that are alleged, we think poses a public safety risk, so we believe no bail was warranted," said Deputy District Attorney, Eric Bodnar.

Confesor's arraignment follows a nearly four-day-long search that ended with San Diego police arresting him on Sunday.

Confesor is accused of entering a home located in the 2800 block of Wellington St. in the early morning of April 18. According to police, Confesor entered the house through an unlocked door and sexually assaulted a 5-year-old girl while she was asleep in her bed.

As San Diego Police searched for Confesor, three days later, Confesor was seen on video surveillance footage returning to the same home and entering the property. He did not gain entry into the main residence, and no one was harmed.

He was arrested Sunday night after officers patrolling the area recognized him.

At the time, he was drinking a beer on Linda Vista Road, about one and a half miles from the victim's home.

So far, police have not uncovered a criminal history, San Diego Police Department Lt. Michael Swanson said in an interview with CBS 8 on Monday.

“We are no longer searching, we know that we have the correct individual," Swanson said.

Swanson was asked how the victim and her family were doing, Swanson said, "They were still traumatized by the incident, but they were doing okay."

Confesor faces 25 years to life in prison if convicted.

"These parents, these kids experienced something no one should ever have to, let alone this family. It truly is a parents' worst nightmare, and without the collective effort of everyone, we wouldn't have gotten the suspect in custody.  Now that we have, justice can be served," said Bodnar.

Confesor is due back in court for a readiness hearing May 2nd.
